What the CSM is doing is not only illegal its unethical. The CSM would be doing a lot more damage to the Army by making a soldier 100% disabled instead of being patient and letting the boy heal. No one has the grounds to give him an article 15. He was off duty and is not obligated to follow safety protocol like he would on duty. I also don't believe the Army has a protocol for climbing a tree. So under what regulation would you have the right to punish this soldier? It is his own damn fault he hurt himself. If I was his CSM I would have given him an Article 15 to boot, kind of like when a soldier is not wearing the proper PPE or driving at unsafe speeds for conditions.
